Terms, Conditions, and Liability Waiver

By participating in this or any future Masterson Method Course or Program (“Course”)—including but not limited to the Beyond Horse Massage Weekend Course, Advanced 5-Day Course, Fieldwork Program, Certification Completion Course, Light to the Core Course and Masterson Method Equine Specialist Course—I, the undersigned participant, acknowledge and agree to the following:

Acknowledgment of Risk: I understand that equestrian activities, including equine bodywork, involve physical interaction with equines, which inherently carries risks, including, but not limited to, the unpredictable nature of horses, trips and falls, collisions, animal bites, kicks, weather conditions, and terrain hazards. I understand that injuries resulting from these risks can be serious or even fatal.

Assumption of Risk: I voluntarily assume full responsibility for all risks of loss, damage, or injury that may be sustained while participating in the Course, whether supervised or unsupervised, including risks from handling equines, engaging in bodywork techniques, and other activities related to the Course.

Release and Waiver of Liability: I hereby release, waive, discharge, and covenant not to sue The Masterson Method organization, Owners, Employees, Instructors, Coaches, Assistants, facility owners, or any affiliated organizations (collectively referred to as the "Releasees") from any and all liability, claims, demands, actions, or causes of action that may arise from my participation in the Course. This includes, but is not limited to, personal injury or death, property damage, or any other loss or harm arising from the activities involved in the Course.

Indemnification: I agree to indemnify and hold harmless the Releasees from any and all claims, actions, damages, or expenses arising out of my participation in the Course, including any claims brought by others for injury or death, loss, or damage resulting from my actions or negligence.

Welfare and Safety: I agree to follow all safety protocols and instructions provided by the Instructors and Coaches, and to handle equines in a manner that prioritizes personal safety and equine well-being. I acknowledge that I am responsible for my actions while working with the equines and will immediately notify the Instructors and Coaches of any behavior or circumstances that may pose a safety risk. I understand that if for any reason it is deemed by the Course Instructor or Coach that my participation may create a risk to myself or other participants on the Course, I may be asked by the Instructor or Coach to cease participation in the Course, and that if asked I agree to comply with this request.

Medical Considerations: I confirm that I am in good physical health and have no medical condition that would restrict my participation in the Course. I will notify The Masterson Method and its Instructor(s) of any pre-existing conditions, injuries, or limitations before participating in any activities related to the Course; I take full responsibility for determining my healthfulness to participate in the Course.

Scope of Equine Bodywork: I understand that the information, methods, processes and techniques that I may learn in the Course are different from, and not a substitute for, modern veterinarian diagnosis, evaluation, and treatment. I understand that the Course will not be providing veterinarian or medical advice, diagnosis, or treatment.

Photography and Media Release (select Yes or No): I grant permission for my likeness, including photographs or videos taken during the Course, to be used by the Releasees for educational or promotional purposes, without compensation or approval. I understand that if I do not wish to be photographed or included in any media, it is my responsibility to make my wishes known on-site to those who may use their phone or camera to capture images. Do you consent to have audio and/or video recording and/or images taken of you at the course? If no, click the No button and be sure to notify others who may be taking pictures and/or videos on the day of the course.

Intellectual Property and Prohibited Use: All course materials, including but not limited to videos, written content, presentations, worksheets, graphics, and other resources (collectively, "Materials"), are the intellectual property of The Masterson Method and are protected by copyright and other applicable intellectual property laws. Unauthorized use is strictly prohibited and may result in legal action. Materials are:

Provided to you solely for your own personal, non-commercial use.
Not provided for purposes of resale, distribution, public display or performance, or any other uses by you in any form or manner whatsoever.
Not intended to provide specific medical/veterinarian advice.

Trademark Policy: I understand that I may not use The Masterson Method name or logo to represent myself or my business unless I have completed the Masterson Method Certification Program and earned the title of Masterson Method Certified Practitioner Equine or Masterson Method Equine Specialist. Use of The Masterson Method name and logo by others to promote any professional services is an infringement on trademark rights.

Acknowledgment of Understanding: I have read this waiver and release of liability and understand its contents. I agree to the terms and conditions set forth in this waiver.
